Originally viewed as the suspects who may have perpetrated a physical attack against the Empire actor, the Osundairo brothers were soon viewed as accomplices in a staged hate crime allegedly planned and paid for by Jussie Smollett.
The suit contends that even after police and prosecutors alleged that the January 29 attack was staged and after all charges were dropped against Smollett, Geragos and his firm continued to say publicly in widely reported statements that the brothers "led a criminally homophobic, racist and violent attack against Mr. Smollett", even though they knew that wasn't the case.
The lawsuit alleges that, "Smollett directed every aspect of the attack, including the location and the noose" and that his attorneys defamed the brothers in statements to the media.

The lawyers expressed confidence that the courts would dismiss the lawsuit.
