Smollett faces a felony disorderly conduct charge, with Chicago police accusing him of concocting an attack in which men wearing red hats beat him up, called him homophobic and racist slurs, and put a noose around his neck. Smollett did Chicago Police Superintendent Eddie Johnson announced the arrest in a press conference.

The charge against Smollett carries a maximum sentence of three years in prison. When brought in for questioning, the two claimed that Smollett had paid them to be involved.

Social media erupted in a debate with some rallying support for the actor who professed to be the victim of a hate crime and those who doubted his story from the beginning. Now he's accused of a felony.

Rumors are swirling regarding the drama series "Empire" as actor Jussie Smollett is suspended after being charged with filing a false police report. It could also force the actor, who is black and gay, to pay for the cost of the investigation into his report of a January 29 beating.

Smollett, who plays a gay character on the hit Fox television show "Empire", said he was attacked as he was walking home from a downtown Subway sandwich shop. "Given these circumstances, we intend to conduct a thorough investigation and to mount an aggressive defence".

On Feb. 13, two Nigerian brothers, Olabinjo Osundairo and Abimbola Osundairo, who reportedly knew Smollett personally, were detained in connection with the alleged attack, but police now believe that Smollett hired the two brothers to carry out the attack on him.

The brothers, who were identified by their attorney as Abimbola "Abel" and Olabinjo "Ola" Osundairo, were held for almost 48 hours on suspicion of assaulting Smollett. Police sources said the brothers are cooperating with law enforcement.

Detective Commander Edward Wodnicki said at the news conference that after questioning the brothers for almost two days last week, they were released and ruled out as suspects. He also ordered Smollett to surrender his passport and have no contact with the two brothers with whom he allegedly orchestrated the attack.

Smollett has helped to "drag Chicago's reputation", Johnson said.

Smollett was charged by prosecutors, not the grand jury.

One of the men has appeared on "Empire", Guglielmi said.

"I'm offended by what happened and I am also angry", he said.
