The attorney for the man accused of assaulting Sen.

Kelsey Cooper Paul's Kentucky-based communications director said about the senator that he "was blindsided and the victim of an assault".

"The unfortunate occurrence of November 3 has absolutely nothing to do with either's politics or political agendas", a statement by attorney Matthew Baker said. Rand Paul's absence while recovering from an assault in which his neighbor is charged creates another challenge in what's become a daily "Maalox moment" while trying to keep together his slim Republican majority.

Paul suffered five broken ribs in the incident, a spokesman for the Kentucky Senator said.

In a statement Sunday, Paul's chief of staff, Doug Stafford, spoke of the altercation and explained that Paul's injuries included five fractured ribs, three of which are partly or completely cracked. Although the alleged perpetrator, Rene Boucher, 59, is reportedly a registered Democrat, investigators can not determine if the crime was politically motivated. "It was a very regrettable dispute between two neighbors over a matter that most people would regard as trivial".

Kentucky State Police say the FBI is investigating to see if the attack was politically motivated, which Boucher's attorney disputed.

At the time of the assault, Paul had "trouble breathing due to a potential rib injury", according to a criminal complaint filed in Warren County District Court.

Boucher, 582 Rivergreen Lane, was released Saturday night from the Warren County Regional Jail on a $7,500 bond, according to online jail records.

An arrest warrant obtained by Courier Journal stated that Boucher allegedly "tackled him from behind". An automated phone system at the jail did not provide access to lawyer information for Boucher.

The Kentucky State Police told Fox News they are still running an active and open investigation and just learned of Paul's condition.

"We are working with our state and local partners to determine if there was a violation of federal law", Habich said.
